A practice in the criminal justice system that is intended to increase justice is bound to decrease it it. This is a nonpartisan puzzle; people of all political persuasions will probably agree about the problem with this practice. What is it?

Innocent until proven guilty relevant? that the burden of proof is on the prosecutor/government? That suspects are sometimes held in jail before being found guilty or innocent?

Are other jail inmates relevant? Violence? Drugs? Any sort of theft? Psychological problems? Suicide?

Relevant that criminals are not found "innocent" but rather "not guilty" (which could include situations where there is a legal technicality but the criminal is obviously did the accused act, ir where there is lack of proof either way, etc.)

Is it relevant that some people might find a given punishement more endurable than others?

Is the relevant practice specific to the United States? To common law systems? Or is it usually also applied in Continental Europe? Sharia countries? China? Was it usually appied in the Eastern Bloc countires before the end of the 1980s? Would it have applied in 1750 England? 1550 England? 1250 England? 980 Iceland? The Roman Republic? Athens when Socrates was convicted?

Kosher meat relevant? How if you're Jewish, you're allowed to request Kosher prison meat? And the meat is of significantly higher quality than the non-Kosher meat? Thus discriminating against non-Jews, when it existed to not discriminate against Jews?

Was the purpose of the practice ensuring equal conditions to all prisoners? Ensuring lighter conditions to certain types of prisoners? Ensuring harder conditions to certain types of prisoners?

House arrest seems like a lenient alternative to imprisonment, but as Alan Dershowitz has pointed out, it is "inherently discriminatory." Just think of the difference between house arrest in a mansion & in a hovel. And just look at my new puzzle at the bottom of the page.

Interesting puzzle, especially because the concept of house arrest does not (or barely) exist in Germany.
But you're right, the concept is discriminatory indeed.
