For whomever may have done the neglecting, did this person/group do something that should not have been done? fail to do something that should have been done? Did the injuries occur outside? inside? somewhere in between (such as in a tent or a pagoda)? Was it someplace that Jean went regularly? daily? weekly? Was Jean with anyone at the time? If so, was anyone else injured? even a possibility of anyone else getting injured? Was Jean injured because she was in the wrong place at the wrong time? Was it something about her appearance that led to her injury? Something about her personally? Could she have been injured in the same way 100 years ago? 200? 1000? |

RECAP: Jean is a HAF. They are HA mixed, but its not really relevant. We are saying that there are 2 of they. They=they’re. Jean’s in juries are relevant and were extremely painful on the order of a broken leg, but not life threatening. They are professionals in a criminal justice-related field. Jean's age is not relevant but she is 58. Her profession, family, religion, political views, marital status and favorite color are not relevant. It is very relevant how Jean sustained her injuries. It was not from a fall, electrocution, a traffic accident, gunshot wound, stab wound, limb caught in machinery, tool-related injury (such as chainsaw, hammer, ice pick, etc.), being trampled by people/animals. There was nothing about Jean’s appearance that led to her injury. Nor was there anything about her personally that made her a target. She could very well have been injured the same way 100 years ago, but it is very unlikely. She could not have been injured in this way 200 years ago or more. It is relevant where the injury occurred but not the nation or city. The injuries were sustained in 2008 during the day and outdoors in a place that Jean went regularly possibly even daily. Jean was alone at the time, although it was possible that someone else could have been injured. One could say that Jean was injured because she was in the wrong place at the wrong time. BLOOPER: Something DID fall on Jean "They" did not say that Jean could have foreseen her injuries. Rather they initially thought someone else could have. They suspect someone hurt Jean through neglect. But it was not through “their” neglect, but someone else’s. Jean was on the platform at a train station. She did not fall off the platform. She did fall over, but a FA is lurking here. She did get hit by a moving object. She was knocked over by a single person, but there is an FA lurking here as well. She was not pushed into anything (except the ground) and was not squashed. She was not crushed by the crowd, nor did a rush of air from a train passing knock her over. She was not hit by some part of the train or something attached to the train. She did not save herself from falling. No one barged into her or stood on her foot. The person that knocked her over was HAM. But his gender is not particularly relevant. Jean was conscious at the time she got knocked over. The person had NOT purposely knocked her over nor had she purposely allowed it. They did not say anything to each other prior to the injuries occurring. There was nothing really about the person that would make one suspect the injuries were foreseeable. Nor was there anything about Jean that would make one suspect the injuries were foreseeable. Jean and the person who injured her have no relationship. |

Or did the person that knocked over Jean knock over something else, that knocked over Jean? And did nothing to stop it? SPOILER: This is a true story and I used the name Jean so I would not have to remember how to spell Gayane. Gayane Zokhrabov, then 58, was knocked down by the flying corpse of Hiroyuki Joho, 18, during a rainstorm in Chicago in 2008, and in December 2011 filed a lawsuit against Joho's estate for compensation for the various injuries she suffered that day (broken leg, broken wrist, shoulder pain). Joho's corpse was "flying" because he had just been fatally struck by a fast-moving train as he dashed through the storm across several tracks -- while Zokhrabov was waiting on a nearby station platform. A judge initially ruled that Zokhrabov's injuries were not a "foreseeable" result of Joho's crossing the tracks, but in December, a state appeals court reinstated the lawsuit.
