It used to be illegal to obtain what I'm thinking of without first purchasing a license. Nowadays, it's common and usually legal to obtain it without a license, even though the same licenses are still sold. On the other side of the coin, whereas penalties for stealing this thing were often much more lax for license holders than for non-license holders, today's license holders might be punished at the same level as a non-license holder. Explain. |

Would people steal a marriage license for the purpose of sex/rape? And with a license the offender wouldn't receive as harsh a punishment? But now that marital rape is considered the same as nonmarital rape, the punishment would be the same? |

Correct? yes Spoiler: I'm thinking about sex. It was often illegal to have sex outside of marriage in older times (and still technically is in some U.S. states), but today premarital sex is common. However, penalties for marital rape, which was usually not even prosecuted, have greatly increased. |
