Malcolm was in the UK and he hit a bird. He was arrested by the RSPCA for animal abuse.
Ellena was in the USA and she hit a bird. She was applauded.
Why such different outcomes?

I think it's about time that these loopholes in the American justice system were brought to the fore.

Did Malcolm hit a bird with his car? a gun? other weapon? bare hands? other item?
Same questions for Ellena?
Same kind of bird in either case? If so, LTPF list of avians? Or does it matter what kind?

A few years ago, a bird hit our windshield at about 6 p.m. - a crow-sized bird. The next day, the same thing happened. Had not happened in many years of both of us driving, and then twice in 24 hours - and hasn't happened since. What are the odds on something like that?

Bird - flying little fellow with beak, wings and feathers?
If yes, was it the same species of bird in both cases?
Did either Malcolm or Ellena hit a bird publicly?
If Malcolm was a woman, would the outcome be the same?
If Ellena was a man, would the outcome be the same?
If Ellena hit a bird in UK, other circumstances the same, would she have been applauded?

Did Ellana hit a badminton birdie? Although they surely play badminton in the UK, don't they? It was invented there!
In any case, non-animate thing?

Although they surely play badminton in the UK, don't they? It was invented there! It was indeed, but in the UK they are called by their original name of "shuttlecock" or "shuttle" for short.

So another nice easy pre-Christmas puzzle is closed :-)

***************Spoiler***************

Malcolm hit a parrot in a pet shop when it squawked "Fatty! Fatty!" at him as he walked past. The pet shop notified the RSPCA who organised Malcolm's arrest.

Ellena was playing badminton in the USA. She hit what in the UK we would know as a 'shuttlecock' or 'shuttle' but which in the USA is known as a 'bird' or 'birdie'. It was a good defensive drive down the line to win the point, so those watching the game applauded.

Well, you could have made us figure out why Malcolm hit the parrot.
Not that I'm complaining. Fun puzzle, which we can use more of this time of year.
